The terms of using this site, and what it is not.

This site publishes work and takes inquiries. It does not sell anything, quote anything, or begin anything. These terms say what using it means and where the boundaries are.

Who this is with

This agreement is between you and Ehsan Kaykhah, an individual based in Los Angeles, California, who works professionally as KAY. Where these terms say he or KAY, they mean the same person.

Using this site means accepting these terms. If you do not accept them, the remedy is simple and costs nothing: do not use the site.

What this site is not

Everything published here — case studies, figures, methods, the framework — is a record of work already done. It is not an offer, a proposal, a quotation, or a commitment to do anything for you.

No engagement begins until there is a written agreement signed by both sides, naming scope, timing and fee. A conversation, an email, a booked call, or anything the assistant says is not that agreement and cannot become one by accident.

Nothing here is legal, tax, financial, immigration or investment advice, and it is not a substitute for advice from someone qualified to give it in your jurisdiction.

The assistant

Ask KAY is software. It is not Ehsan, it does not speak for him, and it cannot commit his time, agree a price, or accept a brief on his behalf.

It answers from what is published on this site and is built to say it does not know rather than guess. It can still be wrong, and being confidently wrong is a thing software of this kind does. Check anything that matters before you rely on it, and if the two disagree, the published page is right and the assistant is not.

It will not quote a figure, because there is no figure to quote before scope is known. Any number that appeared to come from it would not bind anyone.

What belongs to whom

The text, photographs, films, drawings, the monogram and the wordmark on this site are owned by Ehsan Kaykhah or used with permission. They are published so they can be read and considered, not so they can be reused.

You may read, print and share a page for your own use, and quote a short passage with attribution and a link. You may not republish the work as your own, use it to train a model, sell it, or take the photographs out of it.

The names and logos of clients, ventures and partners belong to their owners and appear here as a record of the work. Their presence is not an endorsement of you by them.

Using it reasonably

Do not try to break the site, read parts of it that are not published, scrape it in bulk, or use the assistant to send abuse, to extract its instructions, or to run up cost on someone else's account.

There are rate limits and a monthly ceiling. Reaching them is not an error and does not mean anything is broken — the assistant stops answering and offers a call instead, which was always the better route.

Access can be refused. That is a last resort and has never yet been needed.

Links to elsewhere

This site links to social profiles, venture sites and other people's work. Those are theirs. What they publish, and what they do with a visit, is under their terms and not these.

No warranty, and the limit of liability

The site is provided as it is. It is written carefully and checked, and no promise is made that it will be available without interruption, free of error, or fit for a particular purpose of yours.

To the fullest extent the law allows, Ehsan Kaykhah is not liable for indirect, incidental or consequential loss arising from using this site or the assistant, including lost profit or lost opportunity. Where liability cannot be excluded, it is limited to one hundred United States dollars.

Nothing in these terms limits liability for fraud, for a wilful act, or for anything else that California law does not permit to be limited.

Which law, and where

These terms are governed by the law of the State of California, without regard to its conflict-of-laws rules. Any dispute belongs to the state or federal courts sitting in Los Angeles County, California, and both sides accept that those courts may hear it.

If one clause turns out to be unenforceable, the rest still stands.

Changes, and which version counts

These terms can change. The date at the top is the date of the last substantive change, and using the site after that date means accepting the version you find here.
